Introduction

TapOnIt, LLC.  d/b/a Sway, our subsidiaries, and affiliates (collectively, “TapOnIt,” “Sway,”  “Company,” “we,” or “us”) in connection with the taponit.com, taponit.m.txttoi.com, and textsway.com websites are committed to protecting your privacy. The following policy (“Privacy Policy”) describes our practices for collecting, using, maintaining, and disclosing information that we collect from you or that you provide to us when you visit our websites (our “Sites”) or use any other products and services made available by us (collectively with the Sites, the “Services”).

Sway is a brand name operated by TapOnIt, LLC. We may earn commissions on purchases made through Sway affiliate links. We do not sell subscriber information.

We ask that you read this Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it. The use of information collected through our Services will be limited to the purposes described under this Privacy Policy and our Terms & Conditions (or other relevant customer contracts). By accessing or using the Services, you agree to this Privacy Policy. Please be aware that if you are using the Services on behalf of an entity, you are agreeing to this Privacy Policy for that entity and representing that you have the authority to do so (in which case “you” will refer to that entity). If you do not agree with our policies and practices, your choice is not to use the Services.

If we make material changes to this Privacy Policy, we will notify you by updating the date of this Privacy Policy and posting it on the Service. Information we obtain from social media platforms. We may maintain pages for TapOnIt and Sway on social media platforms, such as Facebook, LinkedIn, Twitter, Google, YouTube, Instagram, and other third-party platforms. When you visit or interact with our pages on those platforms, the platform provider’s privacy policy will apply to your interactions and their collection, use, and processing of your personal information. You or the platforms may provide us with information through the platform, and we will treat such information in accordance with this Privacy Policy.

Information we obtain from other third parties. We may receive personal information about you from third-party sources. For example, a business partner may share your contact information with us if you have expressed interest in learning specifically about our products or services or the types of products or services we offer. We may obtain your personal information from other third parties, such as marketing partners, publicly available sources, and data providers. We do not buy or sell data.

To display advertisements. We work with advertising partners to display advertisements on the Service or elsewhere online, including through social media partners. These advertisements are delivered by our advertising partners and may be targeted based on your use of the Service or your activity elsewhere online. To comply with the law. We use your personal information as necessary or appropriate to comply with applicable laws, lawful requests, and legal processes, such as responding to subpoenas or requests from government authorities.

For compliance, fraud prevention, and safety. We may use your personal information and disclose it to law enforcement, government authorities, and private parties as we believe necessary or appropriate to (a) protect our, your or others’ rights, privacy, safety, or property (including by making and defending legal claims); (b) enforce the terms and conditions that govern the Service; and (c) protect, investigate and deter against fraudulent, harmful, unauthorized, unethical or illegal activity.

We may create anonymous, aggregated, or de-identified data from your personal information and other individuals whose personal information we collect. We make personal information into anonymous, aggregated, or de-identified data by removing information that makes the data personally identifiable to you. We may use this anonymous, aggregated, or de-identified data and share it with third parties for our lawful business purposes to analyze and improve the Service and promote our business.

How We Share Your Personal Information

We do not sell your information or share your personal information with third parties without your consent, except in the following circumstances or as described in this Privacy Policy:

Vendors Offering Goods and Services on Our Service- We may share your personal information with the vendors that offer goods and services on our Service, including for purposes of fulfilling the goods and/or service that you ordered (including processing payment/refund information, arranging for shipping, and providing you with invoices and/or order confirmations). We do not control the third party’s use of your personal information.

Service providers include Shopify, Stripe, Google Analytics, Wildfire, Impact.com, Skimlinks, Mavely, and IMImobile- We may share your personal information with third-party companies and individuals who provide services on our behalf or help us operate the Service (such as payment processors, customer support, hosting, analytics, email delivery, marketing, and database management services). These third parties may use your personal information only as directed or authorized by us and in a manner consistent with this Privacy Policy and are prohibited from using or disclosing your information for any other purpose. For some transactions, including e-gifts, we use Stripe as our payment processor. Stripe uses and processes your complete payment information in accordance with Stripe’s privacy policy: https://stripe.com/privacy. Professional Advisors- We may disclose your personal information to professional advisors, such as lawyers, bankers, auditors, and insurers, where necessary, during the course of the professional services that they render to us.

Do Not Track

Where we are required by law to collect your personal information, or where we need your personal information to provide the Service to you if you do not provide this information when requested (or you later ask to delete it), we may not be able to provide you with our services. The Services may contain links to other websites or online services that are operated and maintained by third parties and that are not under the control of or maintained by Mavely.  Such links do not constitute an endorsement by TapOnIt of those other websites, the content displayed therein, or the persons or entities associated therewith. This Privacy Policy does not apply to this third-party content. We encourage you to review the privacy policies of these third-party websites or services.

Other sites, mobile applications and services

The Service may contain links to other websites, mobile applications, and other online services operated by third parties. These links are not an endorsement of or representation that we are affiliated with any third party. In addition, our content may be included on web pages, mobile applications, or online services that are not associated with us. We do not control third-party websites, mobile applications, or online services, and we are not responsible for their actions. Other websites, mobile applications, and services follow different rules regarding the collection, use, and sharing of your personal information. Accessing and Correcting Your Information

If you wish to access, update, correct, or delete any Personal Information in our possession that you have previously submitted via the Services, you may access your profile in your account and make updates. The security of your personal information is important to us. We take reasonable steps to protect the Personal Information provided to us from loss, misuse, unauthorized access, disclosure, alteration, or destruction. However, security risk is inherent in all internet and information technologies, and we cannot guarantee the security of your personal information. Therefore, you should take special care in deciding what information you send to us. Please keep this in mind when disclosing any Personal Information to us via the Internet. In the event that personal information is compromised as a breach of security, TapOnIt will promptly notify our customers in compliance with applicable law.

International data transfers

We are headquartered in the United States and have service providers in other countries and your personal information may be transferred to the United States or other locations outside of your state, province, or country where privacy laws may not be as protective as those in your state, province, or country.

Children Under the Age of 13

Notice to California Residents.

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a calendar year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. You have the right to know whether your personal information is being sold. Your personal information is “sold” when a third party provides it for monetary or other valuable consideration for a purpose that is not a “business purpose” as set forth in the California Consumer Privacy Act of 2018 (CCPA) or other U.S. state data privacy laws. Please note a “sale” does not include when we disclose your personal information at your direction or when otherwise permitted under law. TapOnIt does not sell your personal information.

If you are under 18 years of age, reside in California, and have a registered account with the Site, you have the right to request removal of unwanted data that you publicly post on the Site. To request removal of such data, please contact us using the contact information provided and include the email address and phone number associated with your account and a statement that you reside in California. We will ensure that the data is not publicly displayed on the Site, but please be aware that the data may not be completely or comprehensively removed from our systems.

Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.

Please note that the Services are directed toward users who reside in the United States. By using the Services, you consent to the collection, storage, processing, and transfer of your information in and to the United States or other countries and territories, pursuant to the laws of the United States.
